Contest Rules

1) No purchase or registration is necessary to enter or win. A purchase or registration does not improve your chances of winning.

2) The contest begins on 09/17/03 and ending on 10/17/03. There is one way to enter the Berkleemusic.com contest. Visit Berkleemusic.com Web site at www.berkleemusic.com/contest. Complete and submit the online registration form any time between 09/17/03 and 10/16/03. All entries become property of Berkleemusic and will not be returned or acknowledged. Limit: One entry per person! Use of automated devices not valid for entry. No mechanical or electronic reproductions permitted. Reproduction of online entry form not valid for contest entry. Photocopied or incomplete entries are void. All entries must include valid mailing address and email where entrant may be reasonably contacted in the event of a winning entry.

3) Prize package consisting of: an Gibson Memphis ES-135 (Retail Price: $1656.00) electric guitar and Berklee Press Super Jazz Pack (books and DVDs). Any tax liabilities are solely the responsibility of the winner and the winner will be required to provide his or her United States social security number for tax purposes. All federal, state, local, municipal and provincial laws and regulations apply. Berkleemusic shall be deemed sole interpreter of the rules and conditions. By participating entrants acknowledge and agree to be bound by these rules and the decisions of Berkleemusic are final. Prize is guaranteed to be awarded.

4) Random drawing of the winner will be conducted on or about 10/20/03 from among all eligible online entries received. Odds of winning depend on number of eligible entries received. Winners will be notified by e-mail or regular mail. If a prize or a prize notification letter is returned as undeliverable, it will result in disqualification, and the prize will be awarded to an alternate winner in a random drawing. The winner must accept the prize within 5 business days after notification. If the winner fails to do so, an alternative winner will be awarded the prize in a random drawing. Prizes will be awarded within approximately 30 days after random drawing. Winners may not substitute or transfer prize. Berkleemusic reserves right to substitute any prize for one of equal or greater value in the event a prize is unavailable. Prizes are not redeemable for cash. Except where prohibited by law, entry constitutes permission to use winner's name, likeness, hometown and prize won for promotional purposes without further compensation. Berkleemusic reserves the right to substitute a similar prize of equal or greater value.

5) By participating in this contest, all entrants agree to release Berkleemusic, its parent companies, divisions, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective employees and consultants from any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons and/or property which may be sustained in connection with the receipt, ownership, or use of any prize or while preparing for, participating in, or travelling to or from any prize related-activity.

6) Berkleemusic is not responsible for any injury or damages to entrant's or any other person's computer related to or resulting from playing or downloading any materials in the contest. Berkleemusic is not responsible for lost, interrupted, or unavailable network server or other connection, miscommunications, failed phone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or late, lost, damaged, misdirected or postage-due mail, or other error of any kind whether human, mechanical, or electronic. CAUTION: Any attempt by an entrant to deliberately damage any Web site or undermine the legitimate operations of the contest is a violation of criminal and civil laws. Should such an attempt be made, Berkleemusic reserves the right to seek damages from any such entrant to the fullest extent permitted by law and to disqualify such entrant from the contest. In the event the contest is, in the opinion of the sponsors, compromised by virus, bugs, non-authorized human intervention, or other causes beyond the control of Berkleemusic which corrupts or impairs the administration, security, fairness, or proper play of the contest, Berkleemusic reserves the right in its sole discretion to suspend or terminate the online method of entry of the contest, but continue with the mail-in entry method.

7) Employees and the immediate family members of Berkleemusic, their parent companies, divisions, subsidiaries, affiliates, advertising and promotion agencies, and any other persons involved with this promotion are not eligible to enter. All federal, state, and local laws and regulations apply. Contest governed by U.S. law.
